High Court Ruling Ireland for Covid 19 Business Interruption Claims

The High Court has ruled four pub owners are entitled to be compensated by FBD for the disruption their businesses suffered due to the Covid-19 pandemic.

4 Publicans challenged FBD on their insurance policies, FBD had stated that they were previously not offering indemnity to covid 19 related claims.

Today’s landmark decision could pave the way for many more claims for all business sectors in Ireland.  The outcome affects claims made by some 1,000 Irish pubs and restaurants, Mr Justice Denis McDonald found a policy sold by FBD covered losses the pubs sustained by having to close due to the global health emergency.

Insurers will be inundated with claims queries following this outcome.

It is important to note that all insurer wordings are different, not all policies will have the same outcome.

Keep documenting your losses and indeed costs that are still ongoing during lockdown.  Prepare your file for your claim.
